1. READ THESE TERMS CAREFULLY

These General Conditions will expressly regulate the relationships between Gràfiques Mas Almirall SL (hereinafter, "GRÀFIC CENTER") and third parties (hereinafter, "Users") who register as users and / or purchase products through the site GRÀFIC CENTRE official website in Spain (https://www.graficcentre.com).

2. USER OBLIGATIONS

2.1 The User agrees, in general, to use graficcentre.com, to purchase the Products and to use each of the services of graficcentre.com diligently, in accordance with the law, morality, public order and the provided in these General Conditions, and must also refrain from using them in any way that may prevent, damage or impair the normal operation and enjoyment of graficcentre.com by Users or that could injure or cause damage to the property and rights of the graficcentre.com its suppliers, Users or in general any third party.
2.2 Any order processed through graficcentre.com or by means of a written signature on this document implies the express and unreserved acceptance by the User of these general conditions of sale and entails the waiver of any application of its eventual General Conditions.
The order placed by the User includes all the technical characteristics of the product to be manufactured (type of product, size, paper weight, inks to be used, ...), the number of units, the billing and shipping information, the payment method chosen, the price of the product. With the request for the order, the User fully accepts its content and declares himself with sufficient power to carry it out on his behalf or that of his company; Once the order has been notified, GRÀFIC CENTRE will send for informational purposes an acknowledgment of receipt of the order to the User by email containing all the data of the order that the User has made, and said acknowledgment of receipt does not constitute an agreement. by GRÀFIC CENTRE to manufacturing; GRÀFIC CENTRE will agree to the order once it has reviewed all the data included in it, has verified that it correctly has all the necessary elements for the start-up of the production process, especially the design file. , and that it has accepted the payment method requested by the User. The User can modify or cancel their order at any time before it has been confirmed by GRÀFIC CENTRE and once it has already been confirmed as long as it has not gone into production by sending an email to info@graficcentre.com in which they do reference to the number of order. The modification or cancellation of the order requires the acceptance by GRÀFIC CENTRE, which will be given by email of "Cancellation - Order Canceled".
Together with the order form or at a later time, the User agrees to make available to GRÀFIC CENTRE by sending through our website or sending by mail to info@graficcentre.com, the design file containing the data of printing, said file complying with the format and technical specifications required for its correct printing, such as level of resolution of the images, color in CMYK, safety margins, ... being said requirements contained in the section "frequently asked questions" that the User declares to know. The User is responsible for the integrity and accuracy of the data contained in the transmitted print file, and therefore deficiencies in the quality or low resolution of the uploaded images, design errors introduced by the User during the creation process, Photographic, typographical, punctuation or grammatical errors, ... are outside the responsibility of GRÀFIC CENTRE and it is released from any verification of dic hos data. In the event that GRÀFIC CENTRE is in charge of the product design file, according to the User's order expressed in the order and the sending of the necessary texts, logos, and photographs, GRÀFIC CENTRE will design and deliver said file to the User for their review; The User's agreement to the design file made by GRÀFIC CENTRE will imply the acceptance of its content in the same terms listed above in the event that it is the User who sends us the file.

3. PRODUCTS AND PRICES

3.1 GRÀFIC CENTRE reserves the right to decide, at any time, the Products that are offered to Users through the graficcentre.com. In particular, GRÀFIC CENTRE may at any time add new Products to those offered or included in the graficcentre.com, it being understood that unless otherwise provided, such new Products will be governed by the provisions of these General Conditions. Likewise, GRÀFIC CENTRE reserves the right to stop providing or facilitating access and use at any time and without prior notice of any of the different types of Products that are offered in the graficcentre.com.
3.2 The Products included in the graficcentre.com will correspond in the most reliable way possible that the web display technology allows to the Products actually offered. The characteristics of the Products and their prices appear in the graphcentre.com.
3.3 PRICES: The sale prices offered on the website for each product indicate the price including VAT. The preparation of an order by the User incorporates the itemized VAT; The prices of the orders confirmed by GRÀFIC CENTRE are valid for 30 days from the order date.
3.4 The order confirmation sent by GRÀFIC CENTRE is not valid as an invoice, only as proof of purchase.
3.5 In the event that the purchase has been made by a final consumer or a company, the corresponding invoice will be issued. Both will contain the breakdown corresponding to the Value Added Tax if applicable and the shipping costs.
3.6 The client always has the right to receive the paper invoice free of charge, although if he does not state otherwise in his order, we will understand that he expressly consents to receive it electronically (by e-mail). This consent may be revoked by the client at any time, by contacting our customer service team, through the contact section.

5. HOME DELIVERY SERVICE

5.1 The territorial scope of sales through graficcentre.com is exclusively for the Spanish territory of the Peninsula and the Balearic Islands, so the delivery service will only be for that territory. The Products purchased through graficcentre.com will be sent to the delivery address indicated by the User once the payment has been verified, the manufacturing and delivery term being the one indicated in the file of each product (DELIVERY PERIOD) in particular.
5.2 The GRÀFIC CENTRE delivery service is carried out through the Transport Agencies contracted by GRÀFIC CENTER.
5.3 We inform that for logistical reasons of the Transport Agency itself, delivery may take another day in the Balearic Islands and very small towns or far from the main cities.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY

6.1 The User acknowledges that all the elements of graficcentre.com and each of the Products, the information and materials contained therein, the brands, the structure, selection, arrangement and presentation of their contents, and the computer programs used In relation to them, they are protected by the intellectual and industrial property rights of GRÀFIC CENTRE itself or of third parties, and that the General Conditions do not attribute to it with respect to said industrial and intellectual property rights any other right other than those specifically contemplated in the themselves.
6.2 GRÀFIC CENTRE will exempt the User and its buyers from any claim for violation of copyrights, trademarks, patents or similar, when GRÀFIC CENTRE is the one who commissioned the User to design the product.
The User is solely responsible for violations of the rights of third parties, in particular copyright, trademark, patent or similar rights, when it is the User who sends us the design file when placing an order. The User declares that he is in possession of the rights of publication and reproduction of the documentation provided. The User exempts GRÀFIC CENTRE from any claim by third parties for the violation of rights in this regard.
6.3 Unless authorized by GRÀFIC CENTRE or, where appropriate, by the third party holders of the corresponding rights, or unless this is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend , make available, or allow access to the public through any form of public communication of any of the elements referred to in the previous paragraph. The User must use the materials, elements and information that they access through the use of GRÀFIC CENTRE solely for their own needs, committing themselves not to carry out, directly or indirectly, a commercial exploitation of the materials, elements and information obtained through the same.
6.4 The User must refrain from circumventing or manipulating any technical devices established by GRÀFIC CENTRE or by third parties in graficcentre.com.

7. PASSWORDS

GRÀFIC CENTRE will facilitate the use of personal passwords to the user who registers as such on the website. These passwords will be used to access the services provided through the Website. The user must keep the passwords under his sole responsibility in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematics access to the services linked to the Website may be modified at any time by the user. The User agrees to notify GRÀFIC CENTRE immediately of any unauthorized use of their password, as well as access by unauthorized third parties to it.

8. APPLICABLE LAW AND JURISDICTION

These general conditions are ruled by the Spanish Law. The parties submit, at their option, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the user's domicile.

9. Right of withdrawal for consumers and users 

You have the right to withdraw from this contract within 14 calendar days without giving any reason. 

The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the goods.

To exercise the right of withdrawal, you must notify us: Gràfiques Mas Almirall SL (graficcentre.com), C/Sicilia 141, 08013 Barcelona / info@graficcentre.com of your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax or e-mail). 

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the relevant deadline expires. 

Consequences of withdrawal 

In the event of withdrawal by you, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a mode of delivery other than the least expensive mode of standard delivery offered by us) without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any charges as a result of the reimbursement. 

We may withhold reimbursement until we have received the goods back, or until you have provided proof of return of the goods, whichever is the earliest. 

You must return or deliver the goods directly to us at C/Sicilia 141 08013 Barcelona, without undue delay and in any event not later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before this period has expired".

"You shall bear the direct cost of returning the goods; 

You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions to the right of withdrawal 

The right of withdrawal shall not apply to contracts relating to: 

- The supply of goods whose price depends on fluctuations in the financial market which the trader cannot control and which may occur during the withdrawal period. 

- The supply of goods made to the specifications of the consumer and user or clearly personalised. 

- The supply of goods that are likely to deteriorate or expire quickly. 

- The supply of sealed sound or video recordings or sealed computer software that has been unsealed by the consumer and user after delivery.
